Code 4 is a mobile application (“Code 4” app) is a health monitor that provides visibility into Heart Rate Variability, which helps users get a big-picture look at their overall health. The app connects to consumer grade fitness trackers and heart monitors. It was created and developed by Provicta, LLC to help users get a big-picture look at their overall health.

Disclaimer: The heart monitors and fitness trackers that connect to Code 4 are not FDA approved medical devices for diagnosing disease and illness. While Code 4 can help users keep track of their body’s physiological data and provide insight into key health metrics, Code 4 is not intended to be a substitute for professional medical advice and should not be relied on as such.

How it works

Using off-the-shelf hardware, the Code 4 app captures defined biometric data and uploads the information to the cloud where it is analyzed.

Code 4 works in partnership with technology specialists to securely relay participant’s biometric data.

Code 4 takes the privacy of your information veryseriously and will only share it with authorized parties.

Our Commitment to Your Privacy

By using the Code 4 app, and its related internet-based services, websites and software (collectively, the “Service”), you agree to the terms and conditions (“Terms”).  Code 4 and Provicta, LLC may make changes and updates to the Service and the Terms over time and will notify subscribers when changes are made (through in-app notifications, email or website announcements). This privacy policy informs subscribers how their “Personally Identifiable Information” (PII), as described in U.S. privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context.

The Code 4 app does not collect and store PPI via a website, Code4Pro.com, Provicta.com or via an IOS or Android app.

Service Critical Functions

 Code 4 is a service designed to dramatically improve first responder performance under stress by better understanding what situations are causing elevated stress for officers.

What personal information do we collect from the people that visit our blog, website or app?

We do not collect Personal Identifiable Information.  All information is abstracted by an information-less ID.

When do we collect information?

At the beginning of an engagement, we collect information from you when you fill out a form or enter information on our site or in the app. This information will only be associated with 6-character information-less ID and never associated with your Personal Identifiable Information.

How do we use your information?

We will never ask you for your name, address, SSN, email address, etc. We may collect some basic biometric and background information, but at no time in the collection, storage or analysis will there be any association to your Personal Identifiable Information.

How are location services used?

Subscribers may elect to turn on location services for their IOS or Android device; it is not required for the base level product but may be required for advanced functionality and services in the future, where location services may be used to pinpoint the address for emergency calls-for-service.

If used, location services data will only be used for the purpose of understanding and measuring stress in first responders.

How do we protect your information?

Code 4 uses data encryption to protect data in transit and at rest. Data in transit is transported using SSL to encrypt all web communication between the application clients and servers. Data at rest is encrypted with Amazon Web Service’s server-side encryption using AWS EBS encryption. Code 4 uses secure HTTPS protocols to protect data.

Financial data:  Code 4 does not collect credit card data for its Services. Optional product purchase transactions in the future may occur on Shopify, which is certified Level 1 PCI DSS compliant.

Profile data: Optionally, other data may be collected to better understand stress on an individual.  This could include height, weight, gender, years of services.  First, information that is uploaded to us by users is protected and encrypted in our systems. Second, after the data upload there is no Personal Identifiable Information linked to that data.

Do we use ‘cookies’?

We do not use cookies or other tracking services.

Third-party disclosure

We do not sell, trade, or otherwise transfer to outside parties your Personally Identifiable Information.

Third-party links

We do not include or offer third-party products or services in our app.  We may provide links to our first responder agency partner websites, to certifying organizations, and to privacy policies and security certificates of business that support our business operations.

Specific Laws and Standards

California Online Privacy Protection Act (CCPA)

This CCPA Privacy Notice applies to certain California residents (“Consumers”) from whom we collect personal information as a business under the California Consumer Privacy Act of 2018 (California Civil Code §§ 1798.100 to 1798.199) and its implementing regulations, as amended or superseded from time to time (“CCPA”).

For the purposes of this CCPA Privacy Notice, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, or as otherwise defined by the CCPA.

The CCPA may permit you to request information regarding the:

  • Categories of Personal Information (as defined by the CCPA) collected, sold or disclosed by us;
  • Purposes for which categories of Personal Information collected by us are used;
  • Categories of sources from which we collect Personal Information;
  • Categories of third parties with whom we share Personal Information; and
  • Specific pieces of Personal Information we have collected about you and in some cases your Household.

In addition, you may:

  • Opt-out of the sale, if you are ever notified of our intent to sell of your Personal Information; (as mentioned previously Code 4 does not sell subscriber information).;
  • Opt-out of receiving marketing communications from us; however, you may still receive administrative communications regarding our services;
  • Request that we and our service providers delete Personal Information we have collected from you, in some circumstances.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States Bureau of Consumer Protection, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.

Our services are not designed for children, and we do not knowingly collect information from any person under the age of 18.

Fair Information Practices

In accordance with Fair Information Practices, should a data breach occur, we will notify the users via email, website or in-app notification within 7 business days.

CAN-SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.  We collect your email address in order to send information, verify subscription services, and respond to inquiries, and/or other requests.

In accordance with CANSPAM, we agree to the following:
• Not use false or misleading subjects or email addresses.
• Identify the message as an advertisement in some reasonable way.
• Include the physical address of our business or site headquarters.
• Monitor third-party email marketing services for compliance, if one is used.
• Honor opt-out/unsubscribe requests quickly.
• Allow users to unsubscribe by using the link at the bottom of each email.
